1. Scope, Contracting Parties, and Definitions
1.1. These Terms of Use apply to the use of the mobile application (hereinafter “App“) titled “EasyJob4You” and the software and/or database contained therein, provided by EasyJob4You LDA, represented by Managing Directors Helmut Scherübl and Izabela Podgorska, Avenida da República 6, P-1050-191 Lisbon, Portugal (hereinafter “Operator“).
1.2. Users within the meaning of these Terms of Use are registered users who, as consumers, may utilize the Operator’s digital services via EasyJob4You. Users have the opportunity to access EasyJob4You in read-only mode and utilize technical functions.
- 1.2.1. Pursuant to § 13 BGB (German Civil Code), a Consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor attributable to their independent professional activity.
- 1.2.2. Pursuant to § 14 BGB, an Entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their commercial or independent professional activity.
1.3. These Terms of Use contain the final and exhaustive terms applicable between the Operator and the User regarding the services offered by the Operator under this User Agreement. Conflicting or deviating terms of the User shall only apply if confirmed in writing by the Operator.
2. Eligibility for Use
2.1. Eligibility is restricted exclusively to natural persons as defined in Section 1.2.1. Natural persons with limited legal capacity (specifically minors aged 16 and over) may only use EasyJob4You with the consent of their legal representative. If the User does not have full legal capacity, the Operator is entitled to make the use of EasyJob4You conditional upon proof of written consent from a legal representative.
2.2. Each User may set up only one user account for EasyJob4You. Eligibility to use EasyJob4You is personal to the User and is non-transferable.
2.3. By declaring consent to these Terms of Use, the User confirms that they meet the aforementioned requirements at the time of concluding the User Agreement.
3. Registration and Conclusion of Contract within EasyJob4You
3.1. A User Agreement between the Operator and the User regarding the use of EasyJob4You, subject to these Terms of Use, is established upon successful registration or within the scope of read-only access as a visitor to the App.
3.2. To register, the User may sign up by entering their data into the designated online form and clicking the button that concludes the registration process. The data required for the user account is specified in the registration input mask. Sending the registration data constitutes the User’s offer to conclude a User Agreement, which the Operator may, but is not obliged to, accept. The Operator may accept the User’s offer within 24 hours of receipt by sending an electronic confirmation email containing an activation link. The Operator utilizes a “double opt-in” procedure; registration is only complete once the User clicks the activation link in the confirmation email. There is no entitlement to the conclusion of a User Agreement.
3.3. The contract is concluded in German and English.
3.4. The email address serves to identify and personally designate the User. The User must ensure that the email address provided during online registration is accurate and capable of receiving emails from the Operator. If using SPAM filters, the User must ensure that all emails sent by the Operator or third parties commissioned by the Operator can be delivered.
3.5. Data requested during registration must be provided truthfully and completely. The User is obligated to keep this data (including email addresses) up to date. The Operator generally does not verify the accuracy or completeness of the submitted data.
4. Subject of the Contract, Services of the Operator, and Ranking
4.1. Through EasyJob4You, the Operator provides an App that allows Users to post, update, and publish profiles, as well as search for and retrieve job offers from third-party job providers. Job offers are displayed to the User based on a specific match rate with the User’s profile, determined by categories such as job type, distance, hourly wage, and working hours. Direct contact between the User and third parties via the App is not possible. If there is mutual interest in establishing contact outside the App, the Operator stores the match data and transmits it to both the User and the third party.
4.2. The current scope of services and functions is detailed in the service description accessible via [this link].
4.3. Contracts regarding job offers displayed on EasyJob4You cannot be concluded directly between the User and third parties via the App. The Operator acts solely as an intermediary and does not become a party to contracts concluded between the User and third parties. Performance of such contracts occurs exclusively between the User and the third party. The Operator does not accept declarations of intent and does not guarantee that a contract will actually be concluded.
4.4. The Operator provides access to the App and suitable software which remains on the Operator’s server. The Operator is not responsible for establishing or maintaining the data connection between the User’s IT system and the Operator’s server.
4.5. The Ranking of job offers is based on factors including:
- Match between profile conditions (wage, hours) and job offer details.
- Availability of both parties.
- Distance between User’s location and the job site.
- Type of employment (full/part-time, fixed-term/permanent).
- Industry/professional sector.
Factors may be adjusted to maximize relevance (Score). Results with higher relevance are prioritized. This process does not constitute a recommendation or a guarantee of employment.
5. Availability of the App
5.1. EasyJob4You is offered subject to availability. 100% availability is technically impossible and cannot be guaranteed. Disruptions may occur due to maintenance, security, capacity issues, or events beyond the Operator’s control (e.g., network failures, power outages, hacking).
5.2. The software is updated at irregular intervals. The User is entitled to use only the current version of the software.
6. Service Changes and Subcontractors
6.1. The Operator reserves the right to change services or offer different services, provided this is reasonable for the User.
6.2. Changes are permitted if required by law, court order, to close security gaps, if purely beneficial to the User, or if purely technical/procedural without significant impact.
6.3. The Operator may engage third parties as subcontractors.
7. General Obligations of the User
7.1. Users must use the App only within the scope of these Terms. Misuse is prohibited.
7.2. Users are liable for all activities under their access. They must keep login data confidential and notify the Operator immediately of any unauthorized use.
7.3. Prohibited activities include using harmful technologies (viruses, bots, scraping), mass-creating content, or uploading data containing malware.
7.4. Further prohibited actions: systematic harvesting of contact data, harassment of other users, mass advertising (SPAM), and using false identities.
7.5. Performing or preparing for assignments that violate laws against illicit work (Schwarzarbeit) is strictly prohibited.
8. Responsibility for Content
8.1. The User is solely responsible for the content they post. They must ensure it is truthful, legal, and does not infringe on third-party rights (copyright, trademark, privacy).
8.2. Violations include posting: copyrighted material without permission, false statements of fact, criminal content, or discriminatory/pornographic statements.
8.3. Users may not disclose the identity or private information of other users.
9. Moderation and Content Restrictions
9.1. The Operator is not obliged to proactively monitor content but reserves the right to do so and take action in case of violations.
9.2. Suspected illegal content can be reported to support@easyjob4you.ai.
9.3. Human review is generally used for moderation. Automated procedures may be used as a supplement; users have the right to request human review of automated decisions.
9.4. Measures for violations include warnings, blocking/deletion of content, or termination of the contract.
10. Support
10.1. Support for App functions is available via support@easyjob4you.ai. Inquiries are processed in the order they are received.
11. Granting of Usage Rights by the Operator
11.1. The Operator grants the User a non-exclusive, time-limited right to use the App and software for the duration of the contract.
11.2. No ownership or licenses are transferred. All rights remain with the Operator.
12. Granting of Usage Rights by the User
12.1. The User grants the Operator the necessary non-exclusive rights to store, reproduce, and make their content publicly accessible within the App for the duration of the contract.
13. Rights of the Operator, Sanctions
13.1. In case of violations, the Operator may delete entries, issue warnings, or block access at its reasonable discretion.
13.3. If the Operator decides to terminate the service for a User entirely, a 30-day notice period generally applies, unless extraordinary termination for good cause is justified.
14. Remuneration
The use of EasyJob4You is free of charge for Users.
15. Indemnification
The User shall indemnify the Operator against all claims by third parties resulting from the User’s content or misuse of the App, including legal defense costs, unless the User is not responsible for the violation.
16. Liability of the Operator
16.1. The Operator is not liable for performance disruptions in the relationship between Users.
16.2. The Operator has unlimited liability for intent, gross negligence, injury to life/limb/health, and mandatory statutory liability (e.g., Product Liability Act).
16.3. For slight negligence of essential contractual obligations, liability is limited to typical, foreseeable damages.
17. Term and Termination
17.1. The contract is for an indefinite period and can be terminated by either party at any time without notice.
17.2. Applicant data is automatically deleted six (6) months after the conclusion of the application process unless express consent for a candidate pool is provided.
17.3. If the User provides express consent for the inclusion of their applicant data in a candidate pool, the storage period of the data shall be governed by the duration specified in the consent or until such consent is revoked. The contract term for the applicant function shall be extended accordingly.
17.4. The remaining functions of the App shall remain unaffected by the termination of the applicant function, provided that personal applicant data is no longer processed.
17.5. The right of both parties to extraordinary termination for good cause remains unaffected. Good cause exists if the terminating party, taking into account all circumstances of the individual case and weighing the interests of both parties, cannot reasonably be expected to continue the contractual relationship until the agreed termination date or until the expiry of a notice period. Good cause includes, but is not limited to:
- A material breach of essential provisions of these Terms of Use which is not remedied despite a deadline being set, or is committed repeatedly, making the continuation of the contractual relationship impossible or unreasonable;
- Re-registration during an ongoing suspension of the User;
- The provision of false profile data by the User to conceal their true identity.
17.6. In the event of a justified extraordinary termination of the User Agreement by the Operator, the User is not entitled to create a new user account for EasyJob4You.
17.7. The User Agreement may be terminated in writing or in text form (e.g., via letter or email).
17.8. Upon termination of the contract, the User loses access to their user account. Furthermore, the Operator’s obligation to store data posted by the User expires upon termination of the contract.
18. Consumer Dispute Resolution
The Operator is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
19. Amendment of the Terms of Use
19.1. The Operator reserves the right to amend these Terms of Use at any time, provided the User consents to the amendment.
19.2. Furthermore, the Operator reserves the right to amend these Terms of Use:
- Insofar as the Operator is obliged to do so due to a change in the legal situation;
- Insofar as the Operator is complying with a court judgment or an official decision directed against it;
- Insofar as the Operator introduces additional, entirely new services, functions, or service elements that require a service description in the Terms of Use, unless this adversely affects the existing contractual relationship;
- If the change is merely advantageous to the User;
- Or if the change is due to purely technical or procedural reasons, unless it has significant effects on the User.
19.3. The Operator shall inform the User of significant changes to these Terms of Use in a timely manner and in an appropriate form. Significant changes are those that would considerably shift the contractual relationship to the disadvantage of the User or would be equivalent to the conclusion of an entirely new contract. This includes, for example, regulations regarding the nature and scope of the service or the contract term and termination modalities.
19.4. The User’s right of termination remains unaffected by this.
20. Final Provisions
20.1. The law of the Federal Republic of Germany shall apply to all legal relationships between the parties.
20.2. In the case of consumers, this choice of law applies only insofar as the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has their habitual residence.
